Navigating New Student Visa Priorities: Let TIA Lawyers Guide You

Greetings from TIA Lawyers! If you’re planning to study in Australia or accompany a student as a guardian, there’s some important news you should be aware of. The Australian Government has recently introduced changes to the student visa process, and we’re here to help you understand these updates in a clear and friendly manner.

What’s Changed?

Effective from December 14, 2023, the Australian Government has implemented a new Ministerial Direction (No. 107) to refine the student and student guardian visa application process. This change aims to streamline the way these applications are prioritised, making the process more efficient.

Breaking Down the Update

This new approach prioritizes certain student visa applications, especially those lodged from outside Australia, including:

  • Applicants from the schools, foreign affairs, defence, and postgraduate research sectors.
  • Students enrolling in higher education, ELICOS, VET, and other courses at education providers with a high Evidence Level.

Student Guardian visas and subsequent entrant applications that include a younger family member also receive a boost in priority.

Plus-One Policy

Good news for families! If your application includes secondary applicants, like a spouse or children, they’ll receive the same priority as the primary applicant.

Course Packaging Priority

For students enrolled in multiple courses, the priority is based on the principal course of study.

When Do These Changes Apply?

These updated processing priorities apply to all applications lodged from December 15, 2023, onwards, including pending applications lodged before this date.

Inside Australia? Business as Usual

If you are applying from within Australia, the existing processing arrangements remain unchanged.
